Terms and conditions of sale

1. Validity of the terms and conditions of sale
1.1. The terms and conditions of sale apply to the rights and obligations of the clients (hereinafter Client) of the online shop fendernet.ee (hereinafter fendernet.ee) and FenderNet OÜ arising from the purchasing of used car parts.
1.2. In addition to these terms and conditions, the purchasing of used car parts through the online shop fendernet.ee is governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
1.3. FenderNet OÜ reserves the right to make changes in the terms and conditions of sale without prior notice. The said amendments can be viewed on the website of fendernet.ee

2. Pricing information
2.1. All prices presented in the online shop of fendernet.ee are per piece, in euros, and includes 22% VAT.
2.2. A delivery fee of €8-€30 shall be added to the invoice for goods with a total purchase price of up to €1000, for which the Client has chosen delivery to Estonia.
2.3. The prices apply from placing the order until the expiry of the payment term for the order placed (24 hours since placing the order).
2.4. If an order has been placed prior to an amendment of the terms and conditions of sale or the prices, the terms and conditions that were in force when the order was placed are applied to the legal relationship between the Client and FenderNet OÜ.
2.5. FenderNet OÜ reserves the right to make changes in the sale prices without prior notice. The said amendments can be viewed on the website of www.fendernet.ee

3. Placing an order
3.1 Add the needed spare parts to your order.
3.2 Fill in the required fields on the order page, choose a method of delivery for the spare parts that suit you, and press the link “Send order”.
3.3 FenderNet OÜ will submit an invoice to the e-mail address given when placing the order, upon the payment of which our transport partners will deliver the spare parts.
3.4 Unpaid orders will be cancelled 3 days after the order has been placed.

4. Entry into force of the sales contract
4.1 The sales contract enters into force from the moment when the whole sum of the order has been received in the bank account of FenderNet OÜ.

5. Delivery
5.1 After the entry into force of the sales contract (the Client has paid the invoice), FenderNet OÜ assembles the order and passes it on to our transport partners for delivery.
5.2. The delivery times indicated by FenderNet Ltd apply from the moment the invoice has been paid.
5.3 In order to ensure that there will be no delays in the delivery, please make sure that the information entered upon placing the order is correct.
5.4 We will replace any of the items that have been damaged during transport. If replacement is not possible, we will reimburse the cost of the damaged spare parts.
5.5 FenderNet OÜ is not responsible for a delay in the delivery of the spare parts, if the spare parts have been handed over to the transport partners on time to ensure the delivery term promised to the Client, but the delay in delivery is a result of circumstances that FenderNet OÜ could not have influenced or foreseen.

5.6 Name, telephone number and email address are sent to the transport service providers Itella Estonia OÜ and Eesti Post AS chosen by the customer.  If the goods are to be delivered by courier, the customer address is sent as well, in addition to the other contact details.

6. Right of return
6.1 After the order has been delivered, the Client has a right to withdraw from the agreement within 14 days.
6.2 The spare part(s) must be complete, not disassembled and not damaged. Also, the markings of FenderNet OÜ may not be damaged or missing. According to subsection 53 (4) of the Law of Obligations Act, it is not possible to return goods that have been produced according to the consumer’s specifications—we cannot, for example, take back or replace parts cut from vehicle bodies according to the Client’s request.
6.3 Upon withdrawal from the sales contract, the initial transport costs are reimbursed to the Client in addition to the cost of the spare parts.
6.4 The costs related to the return of the spare parts are covered by the Client. FenderNet OÜ covers the cost of returning the spare parts, if the spare parts delivered were different from the ones ordered or proved to be defective.
6.5 In order to return the spare parts, a corresponding application needs to be submitted via e-mail to info@fendernet.ee within 14 days following the receipt of the spare parts. The Client will be contacted to arrange the return of the spare parts as soon as possible, but no later than within 14 days. The Client must return the spare parts within 30 days, at the latest, after filing the withdrawal application.
6.6 The money for the returned spare parts is reimbursed to the Client when the spare parts have been inspected, but no later than within 14 days.

7. Privacy policy
7.1 Any information and personal data gathered by visiting the website of fendernet.ee and placing orders is treated as confidential and is not disclosed to third parties, except in cases and in the extent provided in the legislation applicable in the Republic of Estonia. You have the right at any time to apply to have your personal data corrected or deleted by e-mailing info@fendernet.ee . We only collect the kind of personal data that is needed in order to provide you with a service or send you offers (if you have expressed a wish to this effect by sending us an enquiry or signing up for our newsletter). Data may be collected on our website, via e-mail, during a meeting, at an event or over the phone.

8. Force majeure
8.1 FenderNet OÜ is not responsible for any damages caused to the Client or delays in the delivery of the parts, if the damages or late delivery of parts is caused by circumstances that FenderNet OÜ could not have influenced or foreseen.

9. Procedure for filing complaints
9.1 Fendernet OÜ is responsible for any non-compliance with the terms and conditions of the contract or deficiencies related to the parts sold to the Client, if they are revealed within a period of up to two (2) years as of the delivery of the parts to the Client.
9.2 FenderNet OÜ not responsible for any deficiencies inflicted upon the parts due to the fault of the Client, deficiencies resulting from unprofessional mounting, or irregular use of the parts.
9.3 If the parts are not compliant with the requirements or have deficiencies, the Client has the right to demand that the parts be replaced with ones compliant with requirements or without any defects, or to withdraw from the sales contract and return the parts at the expense of FenderNet OÜ. When the Client withdraws from the sales contract, FenderNet OÜ reimburses the sum paid for the parts along with the transport costs to the bank account designated by the Client within 14 days after the parts were returned and their deficiencies verified and inspected.
9.4 If any non-compliances to requirements or deficiencies related to the parts are discovered, we ask you to send a complaint, via E-mail, to info@fendernet.ee, to the address Kalda 9, 11625, Tallinn, or to our website at fendernet.ee, where the Client’s name, contact telephone, number of the invoice presented by fendernet.ee and a detailed description of the non-compliance or deficiency are noted.
9.5 Upon the discovery of the non-compliance or deficiency of the parts, the complaint must be filed within two months after the discovery of the non-compliance or deficiency of the parts.
9.6 All complaints are reviewed and the Client will be contacted as soon as possible, but no later than within 14 days after the receipt of the complaint.

10. The consumer’s right to contact the Consumer Disputes Committee
10.1 If fendernet.ee has refused to resolve the Consumer’s complaint or the Consumer does not agree to the solution offered by Fendernet OÜ and feels that their rights or interests have been violated, the Consumer may contact the Consumer Disputes Committee through the Consumer Protection Board, or a court. Details of the Consumer Disputes Committee are available at the website of the Consumer Protection Board.
